Cyber Liability for Design Firms
Written and reviewed by Michael LaBarbera, licensed insurance agent
Cyber insurance should be reviewed for the data, systems and digital responsibilities of a design firm, rather than assuming an E&O network feature is complete cyber coverage. We review the firm’s exposures and offered cyber terms through our agency alongside its professional liability.
What are the key facts?
| It addresses claims alleging negligent acts, errors or omissions in insured professional services, subject to the policy’s terms. | [Design Professional Liability — The Hartford] |
| Different services and projects create different underwriting exposures, so an application asks how the firm’s work is distributed. | [Great American — Design professional liability application] |
| They describe the firm’s actual professional work and project-delivery methods, not just its software choices. | [Great American — Design professional liability application] |
Map the information and workflows at risk
Identify project files, client information, cloud systems, outside IT providers and payment workflows. Describe backup practices, access controls and the incident-response arrangements the firm already uses.
Ask the agent to distinguish third-party professional-services allegations from the separate response expenses and cyber coverages included in the offered form. Coverage labels are not a substitute for reviewing limits, exclusions and endorsements.
Do not confuse a network feature with a full cyber policy
The Hartford small-business design-professional guide lists third-party network intrusion liability tied to professional services. That feature should not be described as all-purpose cyber insurance or evidence that every cyber expense is covered.
What does professional liability cover for a design firm?
It addresses claims alleging negligent acts, errors or omissions in insured professional services, subject to the policy’s terms.
The insured-services definition matters as much as the firm’s job title. Disclose changes in disciplines, construction responsibilities and project types before relying on a policy for new work.
