Coverage

What does professional liability cover for a design firm?

It addresses claims alleging negligent acts, errors or omissions in insured professional services, subject to the policy’s terms.

The insured-services definition matters as much as the firm’s job title. Disclose changes in disciplines, construction responsibilities and project types before relying on a policy for new work.

Continuity

How does claims-made insurance work?

A claims-made policy responds according to when a claim is made and the policy’s reporting requirements, rather than simply when the work was performed.

Check the reporting deadline, retroactive date, related-claim provisions, exclusions and any known-circumstance conditions. A date checklist cannot establish whether a claim is insured.

Design Professional Liability — The Hartford · Research checked 2026-11-06

Continuity

Is a retroactive date the same as the policy start date?

No. The retroactive date is a prior-acts boundary; the policy start date begins the current insurance period.

A renewed policy may start this year while preserving a much earlier retroactive date. Ask the agent to compare the declarations and prior-acts wording before replacing coverage.

Continuity

Can a design firm change insurers without losing prior-acts protection?

A change may preserve prior-acts protection, but it must be explicitly reviewed in the replacement policy.

Compare the retroactive date and any prior-knowledge or related-claim exclusions. Report known circumstances under the applicable policy provisions; a new insurer does not automatically assume an existing problem.

Continuity

What does tail coverage do?

An extended reporting period can allow later reporting of qualifying claims from earlier services, subject to its terms.

It does not ordinarily insure new professional services after the policy ends. Election deadlines, reporting duration, covered acts and available limits vary; obtain the actual endorsement before making a retirement or cancellation decision.

Continuity

Does retiring or closing a firm end its claim exposure?

No. Claims involving earlier professional work may arise after the firm stops operating.

Discuss continuous coverage or an extended reporting period before cancellation. Keep contracts, project records and prior policies accessible, and distinguish unfinished services from completed work.

Contracts

Can an owner be an additional insured on professional liability?

Some insurers allow it, but adding an additional insured to professional liability extends your coverage to another party and can increase your risk; general liability should be reviewed separately.

Professional liability covers the insured design firm’s professional services. Owner requirements may combine general and professional liability in one paragraph. Separate those requirements and seek agent and attorney review instead of assuming a certificate fixes them.

Additional Insured on Professional Liability Policies — The Hartford · Research checked 2026-11-06

Contracts

Does a certificate change the insurance policy?

A certificate summarizes insurance; it does not create an endorsement or expand the policy’s coverage.

Compare the contract with the declarations and applicable endorsements before signing. A certificate issued for an RFP does not prove every indemnity, additional-insured or duration requirement is satisfied.

What Is a Certificate of Liability Insurance? — The Hartford · Research checked 2026-11-06

Contracts

Does insurance cover every indemnity obligation I sign?

No. A contract can impose obligations beyond the professional negligence liability addressed by the policy.

Watch duties to defend, elevated standards of care and responsibility for other parties’ conduct. Have counsel evaluate the contract and an agent review the insurance language; neither a policy limit nor a certificate is legal approval.

What Is Contractual Liability Insurance? — The Hartford · Research checked 2026-11-06

Contracts

Why do promises of perfect performance matter?

A promise of a perfect outcome can go beyond the ordinary professional standard of care and may create uninsured contractual exposure.

Distinguish reasonable professional services from an express warranty of a project result. Review language about error-free plans, complete compliance and outcome warranties with counsel before acceptance.

Contracts

How should a firm choose its professional liability limit?

Start with contract requirements and project exposure, then compare available policy limits and how defense expenses affect them.

Per-claim and aggregate limits answer different questions. A requested limit is not confirmation the whole contractual obligation is insured. Consider multiple claims, prior work, exclusions, sublimits and the cost-sharing obligation stated in the policy.

Comparing policies

What does defense inside limits mean?

Defense expenses can reduce the amount of the policy limit remaining for damages.

The Hartford small-business design-professional guide describes inside-limit defense. Compare this feature with the exact form being offered rather than attributing it to every policy with the same carrier name.

Design Professional Liability — The Hartford · Research checked 2026-11-06

Comparing policies

Does defense outside limits mean unlimited defense?

No. Outside-limit defense can have separate caps, conditions or eligibility requirements.

Ask whether defense has its own limit and whether all claim types qualify. Compare the endorsement as well as the declarations; the phrase alone is not a complete coverage comparison.

Comparing policies

Is first-dollar defense the same as a zero deductible?

Not necessarily. A damages-only deductible arrangement treats defense differently from damages.

The Hartford guide identifies a damages-only first-dollar-defense endorsement option. Confirm the endorsement in the offered policy; do not assume the option is included or offered for every firm.

Design Professional Liability — The Hartford · Research checked 2026-11-06

Comparing policies

Why should I review a consent-to-settle clause?

It describes how settlement decisions are made and what happens if the insured declines a recommended settlement.

The Hartford small-business guide describes no hammer clause. That sourced fact does not establish other carriers’ wording. Compare the actual clause, any sharing formula and defense treatment before deciding which offer fits.

Claims

Is pre-claim assistance the same as a paid claim?

No. Pre-claim assistance is a separate feature for addressing a potential problem before a formal claim, subject to policy terms.

The Hartford guide lists pre-claim assistance. Read notification requirements and avoid assuming a discussion with the insurer replaces formal claim reporting.

Design Professional Liability — The Hartford · Research checked 2026-11-06

Claims

What is rectification or design-error expense?

It is a specific policy feature addressing qualifying expenses associated with a design error; it is not an unrestricted project correction fund.

The Hartford guide lists rectification expense. Review approval conditions, timing and the exact endorsement before incurring costs or assuming a change order is insured.

Design Professional Liability — The Hartford · Research checked 2026-11-06

Claims

Is disciplinary proceeding defense identical to damages coverage?

No. It is a distinct feature that can have its own sublimit and terms.

The Hartford small-business guide lists disciplinary proceeding defense up to $25K. This is a coverage sublimit, not a premium, and it is not a statement about every carrier or every allegation.

Firm and project fit

Can professional liability be arranged for a single project?

Project-policy options exist, but availability and terms depend on the project and participating firms.

Compare the insured parties, professional-services scope, reporting period and interaction with practice coverage. GUARD’s published architects and engineers material lists a specific project excess endorsement as available; confirm terms during underwriting.

Firm and project fit

Why does the application ask about subconsultants?

Subconsulted services and insurance arrangements help the underwriter understand professional responsibility and the firm’s exposure.

Identify what is delegated, who contracts with whom, billings and how evidence of insurance is collected. A subconsultant’s policy does not by itself erase the primary firm’s contractual obligations.

Firm and project fit

Why do BIM and virtual-design services appear on applications?

They describe the firm’s actual professional work and project-delivery methods, not just its software choices.

Great American’s application asks for the percentage of billings from projects using BIM or virtual design and construction. Describe the services, responsibilities and use of the deliverables rather than answering with a software name alone.

Firm and project fit

Is an owner’s representative the same as an at-risk construction manager?

No. Agency representation and at-risk construction responsibility can create different underwriting exposures.

Great American separates these roles in its application. Disclose construction commitments, subcontracting and design responsibility instead of treating all management services as one profession label.

Great American — Design professional liability application · Research checked 2026-11-06

Applications

Why do carriers ask for billings instead of only a revenue range?

They need the scale and composition of the professional work for their own underwriting definitions.

Great American’s application distinguishes professional billings, subconsultants and specified reimbursables. A quick lead-form range is useful for triage but is not a substitute for a carrier-ready financial schedule.

Applications

Why does project mix matter?

Different services and projects create different underwriting exposures, so an application asks how the firm’s work is distributed.

Describe prior and planned work accurately. A carrier’s referral question is not a market-wide exclusion. The agency can review other markets when a program does not fit, without promising placement.
