Defense Inside vs Outside Policy Limits
Written and reviewed by Michael LaBarbera, licensed insurance agent
Inside-limit defense can reduce the amount remaining for damages, while outside-limit defense may be subject to a separate cap and conditions. Compare the actual endorsements before relying on either label.
What are the key facts?
| The Hartford small-firm design professional guide describes defense costs as inside the policy limit. | [hartford-guide] |
| The same guide lists annual limits from $250K to $2M and deductibles from $0 to $10K. | [hartford-guide] |
| A damages-only first-dollar-defense endorsement is described as available in the guide. | [hartford-guide] |
How does inside-limit defense change the money left for a settlement?
With defense inside limits, every invoice from defense counsel, experts and consultants reduces the same limit that later pays any judgment or settlement. A long dispute over a hospital mechanical system can consume a meaningful share of a modest limit before settlement talks begin. Firms whose contracts specify a minimum limit should ask whether that minimum is expected to cover defense as well as damages.
What should a firm ask about outside-limit defense?
Outside-limit defense can preserve the damages limit, but it may carry its own cap, apply only to certain claim types or require an endorsement. Ask for the exact wording, whether the separate defense amount is per claim or aggregate, and how the deductible applies to defense spending. A label on a quote summary is not a substitute for the endorsement itself.
How do deductibles interact with defense?
Some policies apply the deductible to both defense and damages; others offer a damages-only or first-dollar-defense option so the firm pays nothing until a payment is made to the claimant. When comparing carriers quoted through our agency, line up the limit, defense treatment and deductible treatment together, because a lower deductible may matter less than whether defense erodes the limit.
How should a firm choose a limit when defense erodes it?
Start with the largest limit any current contract requires, then consider the type of work: forensic investigations, structural retrofits and multi-family residential projects tend to produce longer, more expert-heavy disputes. If the expected defense spend is a large share of the limit, a higher limit or an outside-limit endorsement may matter more than the deductible. We quote these options from one application so the trade-off can be seen in one place.
What to send for an agent review
Ask each quoted market to identify the defense limit, retention treatment, endorsements and conditions. Do not compare only the damages limit printed on the first page.
The policy form, endorsements and reported facts control coverage. This comparison is educational; it is not an underwriting decision, a carrier ranking or legal approval.
Frequently asked questions
Does defense inside limits mean my policy limit can be used up by legal fees?
Yes, defense spending reduces the same limit that pays damages under inside-limit wording, as described in The Hartford small-firm guide for its product.
Is outside-limit defense unlimited?
Not necessarily. It can carry a separate cap or conditions; ask for the endorsement wording.
What is first-dollar defense?
A damages-only deductible option under which defense costs are paid without the firm first meeting its deductible, subject to the endorsement.
